The 'Create Cross-Site Groups' right in WSS 2.0 not transferred to Site Permission 'Create Groups' after upgrade

In WSS 2.0 create a custom cross-site group with all permissions selected.
An upgrade was performed to WSS 3.0/MOSS 2007 and now users with the permission levels of the custom group are unable to create a new group in the site. The permission level of the custom group has all permissions selected except for the 'Create Groups' site permission.
The right can be manually added after migration or Object Model code could be written to iterate through to apply the permission.
